Terms of Service

These Terms of Service ("Terms") govern your use of PoleStudioFinder (the "Service"), operated by In Plain Sight Consulting ("we", "us", "our"). By using the Service you agree to these Terms. If you don't agree, don't use the Service.

1. Eligibility

You must be at least 13 years old to create an account. If you're between 13 and 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Accounts

You're responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Tell us immediately at support@polestudiofinder.com if you suspect unauthorized use.

3. Acceptable use

You agree not to:

• Post content that is unlawful, harassing, defamatory, hateful, or sexually explicit involving minors.
• Impersonate any person or misrepresent your affiliation with a studio, instructor, or event.
• Post fake, incentivized, or coordinated reviews (see the Review Guidelines).
• Scrape, spider, or automate access outside our public API or sitemap without written permission.
• Interfere with the Service, probe for vulnerabilities outside a responsible-disclosure process, or upload malware.
• Use the Service to send spam or unsolicited marketing.

We may remove content and suspend or terminate accounts that violate these Terms, at our discretion.

4. User content

You retain ownership of content you submit (reviews, listings, photos, quiz responses). You grant us a worldwide, non-exclusive, royalty-free license to host, display, reproduce, modify (for formatting), and distribute that content in connection with operating and promoting the Service. You represent that you have the rights to grant this license and that your content does not infringe any third party's rights.

5. Studio, instructor, and event listings

Business owners may claim and manage their listing. Verified status indicates we have confirmed basic contact information; it is not an endorsement or a quality guarantee. We may edit listings for accuracy, formatting, or policy compliance.

6. Paid subscriptions

Paid tiers (Verified, Featured, Featured+) are billed monthly or yearly via Stripe. Subscriptions renew automatically until cancelled. You may cancel any time from your dashboard; access continues until the end of the current billing period. Upgrades apply immediately with prorated charges; downgrades take effect at the end of the current period. Yearly plans include a discount reflected at checkout. Except where required by law, fees are non-refundable.

7. Third-party services

The Service integrates with third-party providers (Stripe for payments, Resend for email, Plausible for analytics, mapping providers for location data). Your use of those services is governed by their own terms.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We don't warrant that listings, reviews, or instructor credentials are accurate or complete. Pole dancing carries physical risks; you use any studio, class, or instructor at your own risk.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN PLAIN SIGHT CONSULTING AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF USD $100 OR THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, or your violation of these Terms.

11. Termination

You may delete your account at any time from account settings. We may suspend or terminate access for violations of these Terms or applicable law. Sections that by their nature should survive termination (ownership, disclaimers, limitations, indemnification, governing law) will survive.

12. Changes

We may update these Terms. Material changes will be announced by email or in-app notice at least 14 days in advance. Continued use after the effective date constitutes acceptance.

13. Governing law and disputes

These Terms are governed by the laws of the State of Hawaii, USA, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Honolulu County, Hawaii for any dispute not subject to arbitration or small-claims court.
